Personal data will be processed by TOMOVIL CUEVAS S.A., domiciled at RUA SEIXALVO Nº 4, 32005, Ourense (hereinafter, the "Ford Network Member") and Ford España, S.L., domiciled at calle Caléndula 13, 28109, Alcobendas, Madrid and tax ID (CIF) B-46066361.

PURPOSE OF THIS PRIVACY POLICY

The purpose of this Privacy Policy is to inform you of the manner and purposes for which the personal data obtained when visiting or provided to this website (the "website") or in the context of the purchase of a Ford product or service is collected, processed and explained by the Ford Network Member and Ford España, S.L. (hereinafter "Ford" and both the Ford Network Member and Ford, "we", or "us").

In certain sections of the website, the "Ford Group" entity (Ford Motor Company in the United States of America and its direct or indirect subsidiaries and affiliates) providing financial services in Spain ("Ford Credit") may collect your personal data (for example, when you access your Ford Credit account through the website). This Policy also explains how Ford Credit will process that information.

This website may make it easier for you to purchase or quote for other Ford-related products and services, such as vehicle insurance, financing, leasing or renting, as well as accessories for your vehicle. Some of these products and/or services are offered by Ford partners, who may collect additional data in order to fulfil your request. In this case, these partners will treat your personal data as described in their respective privacy policies or when you provide them with your data.

In addition to this Privacy Policy, some Ford products and services (including some Ford mobile applications) have their own privacy policies, which describe in more detail how your personal information is used in that specific context. You can also find out more about the personal data collected and used by your vehicle by consulting the owner's manual or the corresponding application for mobile devices (if applicable).

WITH WHOM DO WE SHARE YOUR PERSONAL DATA? - DATA RECIPIENTS

Your personal data may be communicated by Ford and the Ford Network Member to:

  • Companies and other organizations to which services have been contracted, such as web-hosting, marketing services, market analysis and information society services.
  • Companies or other organizations to which you have requested or agreed that we may share your personal data;

Where applicable, to other companies that make up the FORD Distribution Network, identified on the website (https://www.ford.es/busca-concesionario).

Professional service providers, such as lawyers, solicitors, notaries, registrars or other similar professionals.

Public bodies, courts, regulators and other administrative authorities, where we consider it necessary to comply with a legal or regulatory obligation, or otherwise to protect against claims against us or third parties, or the security of individuals, or to prevent, or otherwise combat, fraud or for safety or security reasons.

Any third party that purchases, or to which we transfer, all or a substantial portion of our assets and business. In the event of such a sale or transfer, we will use our reasonable efforts to try to ensure that the entity to which we transfer your personal information uses it in accordance with this Privacy Policy.

Ford may also transfer your personal information to Ford Credit, Ford Motor Company and other Ford Group companies, as well as companies that service them. In such cases, we will ensure that your data is used for appropriate purposes in accordance with this Privacy Policy and will enter into appropriate agreements or arrangements for the processing of your data, applying the same or similar security measures as those applied by Ford. INTERNATIONAL TRANSFERS OF YOUR PERSONAL DATA

Your personal data will be processed in accordance with Spanish and European Union regulations and may be transferred within the European Economic Area ("EEA"), as well as to other countries outside the EEA (including the United States of America and India). If we transfer your personal data outside the EEA, we will put in place appropriate measures and safeguards in accordance with our legal obligations to ensure that your personal information is properly protected, regardless of the country to which it is transferred. These safeguards may include obtaining contractual guarantees from any third party that your personal data will be protected by security measures that are equivalent to those applicable to your personal data when it is in the EEA. These guarantees, in the case of the Ford Organisation Companies, are the standard contractual clauses published by the Commission of the European Union.

WHAT PERSONAL DATA DO WE PROCESS?

When you fill out a form (for example, to request a test drive); and automatically, through the use of cookies or similar technologies: you can find more information in our Cookie Policy.

This website allows you to provide, among others, the following personal data:

  • Your name and contract details (address, telephone numbers and email), as well as information about your business or employer if you are applying on behalf of a trader.
  • Information about your vehicle (including car's vehicle identification number –VIN–, licence plate, model, age and mileage).
  • Information about the products and services you are interested in.
  • Other contact details and preferences.

For marketing purposes.

We collect your information if you contact us through the website (for example, we will keep a record of the information you provide if you write to us to contact our customer relations centres).

We may combine the information we hold about you or your preferences, socioeconomic and socio-demographic status, online identifiers, and current contact data collected by third parties such as marketing agencies, but only when those third parties have your consent for this purpose.

When you buy or take your vehicle in for maintenance or repair, we will collect your details, as well as diagnostic information about your vehicle and keep a record of the work done and parts supplied.

If the personal data has been provided by the users, it must be true, and the Ford Network Member and Ford must be notified of any changes to the data, responding in any case to the truthfulness and accuracy of the data provided at all times. By providing your personal data to the Ford Network Member and to Ford, you declare that you are of legal age and that you are fully responsible for this declaration.

HOW DO WE USE YOUR PERSONAL DATA? - PROCESSING PURPOSES

We will process the personal data we collect to:

  • Attend to your requests (e.g. provide test drives or manage catalogue requests).
  • Manage and improve the activities of our companies and our relationship with you.
  • Attend to your questions or complaints.
  • Carry out research and studies.
  • Conduct satisfaction surveys.
  • Send commercial communications about our products and services in accordance with e-commerce regulations.
  • Process invitations to events and information on marketing campaigns and promotions, if requested or authorised by the user. By way of illustration and without limitation, shipments may be made by post, telephone and/or e-mail.

To comply with the legal obligations of the producer and marketer of automotive products and services, to respond to requests for information in the event of legal proceedings or requests from administrative authorities or other third parties, to detect and prevent fraud, or to protect your interests, our interests and those of third parties.

Operate this website, personalise your experience and understand how it is used and how we can improve it.

We may combine and analyse your personal data (including by using automated techniques that utilise current, historical and statistical data) to:

  • Help us develop and improve our products, processes, services and marketing strategies.

We will keep your personal data in a form that can identify you as long as it is necessary to fulfil the stated purposes and meet our legal obligations. In general, this purpose includes the following situations:

Your personal data is reasonably necessary to protect and defend us from claims (usually during the limitation period for the exercise of these actions).

When we are obliged to keep your personal data by the applicable regulations.

The Ford Network Member and Ford have endeavoured to adopt technical and organisational measures designed to ensure the security and integrity of the data, as well as to prevent its alteration, loss, processing or unauthorised access in accordance with current data protection legislation.

The Ford Network Member and Ford will delete the data collected when it is no longer necessary or relevant for the purpose for which it was collected or recorded. In the event that the data collected were to be used for a purpose other than that for which they were collected, users will be informed and their prior consent obtained for such processing.

ON WHAT LEGAL BASIS DO WE PROCESS YOUR PERSONAL DATA? - LEGITIMACY OF PROCESSING

When the processing is necessary for the execution of a contract or contracts to which you are a party or when the data are necessary in the framework of a pre-contractual relationship. These contracts could include, for example, when you participate in a competition, or the customer data has been obtained in the context of the sale of one of our products or services.

Where the use of your personal data is necessary for the satisfaction of our legitimate interests or those of the organisation with which we have shared your personal data and we have ensured that your personal data and your rights in relation to it are protected. When the processing of the data is necessary to comply with the regulations governing the legal obligations of the producer and the marketer in force at any given time, among which are those relating to the placing on the market of products and services, consumer and user protection, product safety, retail management, development of an industrial activity, provision of services in car repair shops, of their equipment and components, environmental (including the management of end-of-life vehicles and other waste from them) and other international (including European Union), state and regional regulations on these matters.

In accordance with the applicable Information Society Services legislation, if a prior relationship exists in the context of the sale of a Ford product or service, the data may be used for the sending of commercial communications concerning Ford products and services which are similar to those which were the subject of the contract, unless you object in the manner provided for that purpose. By way of illustration and without limitation, shipments may be made by post, telephone and/or e-mail.

When we believe that it is necessary to process your personal data in order to comply with a legal or regulatory obligation.

In specific circumstances, when we believe it is necessary to protect the security or vital interests of the data subject or another individual.

Where we have your consent, for example to collect technical information such as cookie data and similar technologies as described in the Cookie Policy, we will use such data to send you commercial communications by email and text message. YOUR RIGHTS

As a natural person, you have the right to know what data we hold about you and for what purpose we process it, as well as to access and rectify it, if necessary. We will do our best to accommodate your request. However, certain regulations, notably those relating to the obligations of the vehicle producer or seller or the vehicle repair service provider, or to product safety or financial regulations (for example, those applicable to Ford Credit's business) could prevent this.

If you have consented to the sending of communications of a commercial nature by Ford and/or Ford Credit, you may withdraw your consent at any time.

The Ford Network Member and Ford reserve the right to modify this Privacy Policy in accordance with applicable law from time to time, effective as of the date of publication of such modification. If we make significant changes in the way we use your personal data we will communicate this prominently on this website or contact you directly. If you do not agree with these changes, do not continue to use this website.
